A Texas homeowner, Melanie McQuiddy, filed a lawsuit against electric utility Xcel Energy, alleging that a splintered power pole owned by the company fell and started a massive wildfire northeast of Amarillo. The fire, known as the Smokehouse Creek Fire, has become the largest wildfire in Texas history, claiming at least two lives and devastating over 1,078,000 acres of land.
Allegations Against Xcel Energy
The lawsuit claims that Xcel Energy’s subsidiary, Southwestern Public Service Company, neglected to maintain safe electrical equipment, leading to the catastrophic fire. McQuiddy’s attorney, Mikal Watts, stated that Xcel Energy will be held accountable for the damages caused by the wildfire.
Negligence and Consequences
The legal action also implicates Osmose Utilities Services, accusing the company of failing to adequately inspect Xcel’s power lines despite being hired for that purpose. The devastating effects of the Smokehouse Creek Fire include the destruction of property, loss of livestock, and immense environmental damage.

Xcel Energy is currently facing numerous lawsuits, including those related to the 2021 Marshall Fire in Colorado, where the company denies responsibility for the damages. Similar cases involving other utility companies, such as Hawaii Electric and PG&E Corp, have resulted in substantial settlements for wildfire victims.
